Terms of Service

Welcome to SPLYT. These Terms of Service ("Terms") govern your use of the SPLYT mobile application ("App") operated by SPLYT ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2. Account Registration
To use certain features of the App, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
3. Use of the App
SPLYT provides a platform for users to discover, organize, and split the cost of yacht charters and water experiences. You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App for any illegal or unauthorized purpose
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Submit false, misleading, or fraudulent information
- Interfere with or disrupt the App or its servers
- Attempt to gain unauthorized access to any part of the App
- Use the App to distribute spam, malware, or harmful content
4. Experiences & Bookings
SPLYT facilitates the booking and cost-splitting of water experiences. By participating in an experience through the App:
- You acknowledge that SPLYT acts as a platform to connect users with experience providers and other users
- You agree to honor your commitments once you join an experience
- You understand that availability, pricing, and details of experiences are subject to change
- You accept that weather and other conditions may affect scheduled experiences
5. Payments & Cost Splitting
When you commit to an experience, you agree to pay your share of the costs as displayed in the App. Payment terms:
- All payments are processed through secure third-party payment providers
- Prices displayed include applicable fees unless otherwise stated
- Refund policies vary by experience and are displayed before you commit
- You are responsible for any taxes applicable to your transactions
6. Community Guidelines
SPLYT maintains a curated community. All members are expected to:
- Treat other members with respect and courtesy
- Show up to committed experiences on time
- Communicate promptly about any changes to plans
- Follow all safety guidelines during water experiences
- Comply with all applicable maritime and local laws
We reserve the right to suspend or terminate accounts that violate these guidelines.
7. Intellectual Property
The App and its original content, features, and functionality are owned by SPLYT and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our express written permission.
8. Assumption of Risk
Water activities carry inherent risks. By using the App to book or participate in water experiences, you acknowledge and accept these risks. You agree that SPLYT is not liable for any injuries, damages, or losses that may occur during experiences booked through the App.
9. Limitation of Liability
To the maximum extent permitted by law, SPLYT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the App.
10. Indemnification
You agree to indemnify, defend, and hold harmless SPLYT and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Termination
We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Any outstanding payment obligations survive termination.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by other means. Your continued use of the App after modifications are posted constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
